OPT

You must have a degree in a STEM (Science, Technology, Engineering, Mathematics) field and work for an E-Verify registered employer. This extension allows for an additional 24 months of work authorization.

 

OPT (Optional Practical Training) is a work authorization for F-1 students that allows them to gain practical experience in their field of study. It is typically valid for 12 months after graduation.

  • An F-1 student who has completed at least one academic year in the U.S.
  • Applying for a job related to your field of study
  • Not already using your full 12 months of OPT at the same education level
 

No, you must wait for USCIS approval and the EAD (Employment Authorization Document) before you start working.

 

OPT employees can take on a wide range of roles depending on their field of study. For instance, if a student has a degree in computer science, they might work as a software developer, data analyst, or systems engineer. OPT allows international students to work in the U.S. for up to 12 months (with a possible extension for STEM fields) in positions directly related to their major, which helps them gain practical experience in their area of study.

When an employee on OPT wants to transition to a full-time work visa, such as the H-1B visa, their employer must sponsor them. The H-1B visa allows companies to hire foreign workers for specialized roles in fields like engineering, technology, and medicine. The employee must apply for the H-1B visa during the annual application window (usually in April), and if selected, they can begin working full-time once the visa is approved. During the transition period, employees are allowed to continue working under OPT until their H-1B status begins, as long as they maintain valid authorization

H1B

The H-1B is a non-immigrant visa that allows U.S. employers to hire foreign workers in specialty occupations, usually requiring at least a bachelor’s degree in a specific field.

 
 
Yes, your employer can file an H-1B petition on your behalf while you are on OPT. If selected and approved, your status will change from F-1 (OPT) to H-1B on October 1st of that year.
 

The H-1B cap-subject petition must be filed in March during the lottery registration period. If selected, the full petition is submitted from April 1st onwards.

Contractor FAQ

For W2 employees, you get paid your first pay-check after 45 days; and moving forward next regular checks will be paid on the monthly basis.

 
 

Please log your weekly hours by Monday at 5 PM for the prior week (Work week is Monday through Sunday).  For any questions on logging hours, please contact our Team at hr@cognitumsolutions.com

 

Please make sure you receive approval from your Manager before working OT. If you do work OT, please mark it on your timesheet.
